Springfield Police DUI Records

The Springfield Police Department handles public records requests through a three-level system. Level 1 requests are for records that are easy to find and do not need a written form. These are free. Level 2 requests must be made in writing to the City Recorder and can include up to 50 pages. The city aims to fill these within five business days.

Level 3 requests are more involved. These are cases where records span more than one department or need review by a city attorney. The city allows up to 15 business days for these. Fees may apply under ORS 192.440(4), which lets agencies charge for the cost of finding and copying records.

Police reports tied to DUI arrests in Springfield fall under this system. An arrest report will list the charges, the time and place of the stop, and the results of any field tests. These reports are public unless they are part of an active case that the police have not yet closed.

Oregon DUI Laws in Springfield

Oregon law calls the offense DUII. The main statute is ORS 813.010. It makes it a crime to drive while under the influence of alcohol, drugs, or a mix of both. The legal blood alcohol limit is 0.08% for most drivers. For commercial drivers, the limit is lower.

Penalties are set out in ORS 813.100. A first conviction brings mandatory fines, possible jail time, and a license suspension. The court may also order substance abuse treatment. Each new offense raises the minimum penalties. A third or later offense can be charged as a felony.

Some first-time offenders may qualify for a diversion program under ORS 813.400. Diversion lets a person avoid a conviction if they complete treatment and meet other conditions. Even with diversion, the case still creates a court record in Springfield.

Note: License suspension from a DUI arrest is a separate process handled by the Oregon DMV. The court case and the DMV action create two different sets of records.

How to Request DUI Records

Start by choosing the right office. If you want the police arrest report, contact the Springfield Police Department. If you want the court file, reach out to the Springfield Municipal Court or the Lane County Circuit Court for felony cases.

For police records, find out which level your request falls under. Level 1 records can be picked up right away. Level 2 and Level 3 requests take longer and may have fees. For court records, you can search online first through the Springfield online docket search or the state court system.

Bring a valid ID when you visit any office in person. Have the full name and date of birth of the person whose record you want. A case number speeds things up if you have one. All of these offices are open during normal business hours on weekdays.
