DUI Laws in Douglas County

Oregon calls drunk driving DUII, which means Driving Under the Influence of Intoxicants. The law is ORS 813.010. It bans driving with a blood alcohol content at or above 0.08 percent. Drug impairment and combined drug-alcohol impairment are also covered. Douglas County DUI records list all such charges as DUII.

First and second DUII offenses are Class A misdemeanors in Oregon. A third or later conviction within ten years is a Class C felony. Douglas County sees both levels in its circuit court. Felony DUI records carry longer retention in the court system. For a first offense, the mandatory minimum is at least two days in jail and a $220 court fee. License suspension is 90 days for a first offense, one year for a second, and three years or more for a third offense.

Under ORS 813.100, Oregon's implied consent law requires drivers to take a breath or blood test when asked by law enforcement. Refusing the test leads to a separate license suspension. DUI Diversion in Douglas County

Oregon law allows some first-time DUI offenders to enter a diversion program instead of going to trial. The rules are in ORS 813.400. If the person completes all program requirements, the DUI charge is dismissed. The arrest record stays, but no conviction is entered.
